Age Limit on Being a Surrogate Mother

Is there age limit to be a surrgant? I have visited a practice in Ohio and they would not accept because of my age? or is this just a preference due to there practice.

You didn’t mention how old you were.

Surrogates need to be at least 21 years old. As to an upper age limit, it will vary by the agency, clinic and intended parents. The general rule of thumb is that a surrogateshould beunder 40 unless she has had a baby in the last 1-2 years.

Again, this is a general rule, as there are no actual upper limits industry wide. It simply depends on the situation. I knew a surrogate who was 44 and delivered triplets, so you never know.

My daughter is under treatment of epilepsy.Both the coupe are otherwise healthy. To avoid complication, as she would be under Sodim valporate, hence they are opting for the help of a sarogate mother. I will turn 62 soon but I’m in excellent health..exercise..my weight is low…but of course I’m post menopausal (age 50-52 I stopped menses). There is always an exception in surrogacy. And mothers helping daughters is one of them. For the woman who posted directly before this post, if you are in good health and your doctor has cleared it, you could act as a gestational surrogate mother for your daughter, even if you are post-menopausal. Its quite common.

My daughter has polycystic Ovary syndrome and is having trouble with fertility. She finally did get pregnant and today learned the fetus died at 8 weeks. If your wife is a surrogate mother for her daughter, and is healthy, she should be eligible to do it. It doesn’t matter if your wife has passed menopause.

You didn’t mention if you had had any children of your own. If not, then absolutely no, you would not be eligible to become a surrogate.

I believe that NY is one of the states that doesn’t care for surrogacy (I could be wrong; hard to keep up with all the states) and in that case, you’d have to find another state to deliver in no matter what your age.

But 21 is pretty much the norm in most states. You could call around to attorneys in surrounding states.

This isn’t an agency vs intended parents issue; its a legal one (the minimum age being 21, that is).

Thank you for your quick response. I now believe its due to the Agency that I went too. This really makes me feel better, I was really discouraged after they said I was to old to participate. I am “35” and had two very healthy natural pregancy’s.
