Can my friend be my surrogate mom?

My husband & I are thinking about having my friend being a surrogate to my child.But the baby will not have my DNA it will have my husband's.We dont want to pay alot of money so I was wondering how I could go about this legally so that the baby would be mine?

If your friend has had at least one child of her own, she may be eligible to become a Traditional Surrogate Mother. You would need to utilize a clinic, where your husband would deposit sperm in a cup. The sperm would then be Artificially Inseminated into your surrogate.

When the baby was born, you would need to do a step-parent adoption to terminate her rights and instate yours.

You will need to contact a surrogacy attorney in your state. The fees should not be nearly as large as a gestational surrogacy, and could be quite manageable depending on what sort of compensation your friend wants.
