I am meeting with a lawyer this coming up week, I would be the surrogate mother, and the intended parents and I are attempting a gestational surrogacy. This is my first journey. I don't even know where to begin to ask questions. I know there are questions I need to be asking him, just don't know where to start. I feel like the mother and I have already agreed upon pretty much everything, excluing fees. Help? Need advice, or some type of track to be lead down....
Reply by Rayven You are meeting with YOUR OWN lawyer, right?
YOU MUST HAVE YOUR OWN LAWYER
I know you want to help this couple, but under no circumstances should you ever agree to "everything" without going through that contract with a fine tooth comb. Their lawyer has been hired to protect the intended parents at all costs, even if it does financial damage to YOU.
I went through thousands of dollars in testing and matching and lawyers fees and walked from a couple (my first journey) because of a clause found in the contract (that had nothing to do with my compensation) that they would not change.
In addition, I have an entire section on this website talking about the things that should and should not be in a contract, and the questions you need to ask. Its found in the "Legal and Insurance" tab to your left.
If you do not have a lawyer, you need one. The lawyer recommended on the Nightmare page is my personal attorney and he practices in Texas. The intended parents are required to pay his fee. He will represent you throughout your entire journey, not just through the contract phase.
