It really depends on which European country she lives in, and what the laws are in that country. Surrogacy laws pertain to the country the child is born in; not the country the parents are from.
Many intended parents seek surrogates outside of the United States to lower the cost of fees that they pay the surrogate. Meanwhile, many European intended parents seek surrogates in the United States because the laws are more favorable here.
You'll need to get a lawyer and investigate your options.
